- Quotations: All initial tour estimates are valid for the timeframe specified on the quotation sheet. Custom itineraries are only confirmed upon explicit receipt of booking verification.
- Securing Dates: A deposit or full payment framework (depending on scale and notice time) may be required to formally secure requested calendar dates.
- Final Balance: Outstanding balances must clear prior to the agreed commencement time of the tour itinerary.
3. Cancellations & Refunds
Because private guiding requires reserved vehicle allocations, advanced third-party destination bookings, and exclusive calendar time, cancellations are subject to the following standard parameters:
- Cancellations initiated well in advance are generally eligible for a partial or full refund, minus any unrecoverable third-party reservation costs (e.g., specialized entrance tickets or accommodation deposits).
- Late-stage cancellations or complete guest "no-shows" on the morning of the itinerary will result in a forfeiture of the fee to cover operational losses.
- We strongly suggest that all traveling guests secure comprehensive travel insurance covering unforeseen medical emergencies or flight schedule interruptions.
4. Itinerary Flexibility & Force Majeure
Operating across coastal paths, mountain passes, and natural reserves means being subject to the dynamic Cape environment. We pride ourselves on delivering curated, immersive journeys, but safely navigating means that:
- We reserve the right to modify routes, mountain accents, or specific destination drops due to severe weather fronts, unexpected road closures, or safety concerns.
- If a core destination element becomes entirely unviable (e.g., Table Mountain cableway closures or marine cruise cancellations), we will provide high-quality alternative experiences or route modifications to match your interests.
5. Client Responsibilities & Safety
Your safety is our primary focus while out on the road and exploring trails. By embarking on a tour, you agree to follow the safety directions of your registered tourist guide. Clients are responsible for ensuring they possess a basic fitness level suitable for selected trail excursions (like peninsula coastal hikes) and for informing us of any dietary limitations or physical considerations prior to setting out.
6. Limitation of Liability
While we carry out all itineraries under professional tourism safety standards, transport protocols, and certified registrations, Wes | Cape Guide accepts no liability for personal injury, illness, delay, damage, or loss of personal property occurred while participating in external adventure activities, multi-day routes, or third-party operated excursions.
7. Governing Law
These terms and conditions, along with all operations and services provided, are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising relative to these services fall exclusively within the jurisdiction of South African courts.
